Notice of Adoption – Cannabis Opt Out

NOTICE OF ADOPTION OF LOCAL LAW

SUBJECT TO A PERMISSIVE REFERENDUM

 

NOTICE IS HEREBY GIVEN that at a meeting held on the 6th day of December, 2021, the Village Board of the Village of Warwick, Orange County, New York, duly adopted a Resolution adopting Local Law No. 4 of the year 2021 entitled:  “A Local Law To Opt Out of the New York State Cannabis Law (Chapter 7-A of the Consolidated Laws of the State of New York) In Regard To Retail Sales And In Regard To Establishments For On-Site Consumption”, an abstract of which follows, which Local Law was adopted subject to a permissive referendum pursuant to Municipal Home Rule Law of the State of New York.

Abstract:  The purpose of this Local Law is to promote the public health, safety and welfare by opting out of the New York State cannabis legalization legislation in regard to retail sales and in regard to establishments for on-site consumption.

Said Local Law shall take effect forty-five (45) days after the date of its adoption or when approved by the affirmative vote of a majority of the qualified electors of the Village voting on such proposition.  If within forty-five (45) days after the adoption of the Local Law there be filed with the Village Clerk of the Village of Warwick a petition signed, and acknowledged or proved or authenticated by electors of the Village in number equal to at least twenty per centum of such electors in the Village, as shown on the register of electors for the previous general village election, protesting against the Local Law and requesting that it be submitted to the electors of the Village for their approval or disapproval.
